These Terms and Conditions apply to crankycoqui.com, operated by Cranky Coquí LLC ("Cranky Coquí," "we," "us," or "our"), a restaurant and merchandise business at 32 Center Street, Wallingford, CT 06492. They explain the rules for using our website and buying merchandise through our online store.

1 Using our website

By using our website, you agree to these terms. If you do not agree, please discontinue use. To place an order, you must be legally able to enter into a binding agreement or have a parent or legal guardian place the order for you. You must provide accurate information and be authorized to use the payment method submitted.

You may not use the website for fraud, unlawful activity, impersonation, unauthorized access, or interference with its security or operation. If an account feature is available and you use it, keep your login information secure and notify us of suspected unauthorized use.

2 Restaurant information and availability

Menus, prices, hours, promotions, event details, and availability may change. Photographs are illustrative; actual presentation and merchandise colors may vary. Promotional offers are subject to the conditions stated with each offer. Changes to website information do not authorize us to change an accepted order without your agreement or a lawful cancellation and refund.

Please tell our staff about food allergies or dietary requirements before ordering. Website descriptions may not list every ingredient, and we cannot guarantee an allergen-free environment. This statement does not limit our food-safety responsibilities or your legal rights.

3 Merchandise orders and payment

Our online merchandise is sold by Cranky Coquí and produced and shipped through our fulfillment partner, Printful. Contact us for assistance with your purchase; using a fulfillment partner does not remove our responsibilities to you as the seller.

Review the product description, size information, quantity, and delivery address before paying. Prices are in U.S. dollars unless stated otherwise. Applicable taxes and any shipping charges are shown before payment. Merchandise is generally made to order. Small differences caused by screen settings or production methods do not excuse defective, incorrect, or materially misdescribed goods.

We may decline or cancel an order for a legitimate reason, such as unavailable stock, an obvious pricing error, suspected fraud, or inability to deliver. If an issue affects your order, we will contact you and either obtain your agreement to a change or cancel and promptly refund the affected payment. We will not charge a corrected price without your approval.

4 Shipping returns and cancellations

Our Shipping & Returns Policy forms part of these terms for merchandise purchases. It explains delivery estimates, shipping destinations, order changes, damaged or incorrect items, lost packages, and refunds. Please review it before ordering. The version disclosed when you place your order applies to that order, subject to any rights required by law.

Because merchandise is made to order, changes, cancellations, and size exchanges may be limited as described in that policy. These limits do not remove remedies for defective or misdescribed goods or other rights that cannot legally be waived. Estimated delivery dates are not guarantees. If shipment is delayed, we will provide any notices, cancellation choices, and refunds required by law.

Do not send merchandise to Printful or bring or mail it to the restaurant for a return unless we have given you return instructions.

 

5 Reservations food orders catering and gift cards

Food orders, reservations, catering, private events, and gift cards may be arranged through separate platforms or agreements. Relevant booking or checkout terms will be provided with the transaction. Any seating time limit, deposit, cancellation charge, service charge, or other special condition must be disclosed before you commit; this page does not create an undisclosed charge.

For pickup or delivery ordered through another platform, review that platform’s checkout, cancellation, and support information. Contact us about food quality or restaurant service, and use the platform’s support channel when payment or delivery must be handled there. Merchandise return rules do not apply to food orders or gift cards.

Gift cards are subject to the terms disclosed when purchased and applicable law. Do not assume a restaurant gift card can be used in the merchandise store. Alcohol-related purchases or service are subject to legal age requirements, identification checks, and applicable law.

 

6 Our content and your submissions

Our name, logos, artwork, photographs, website text, and designs belong to Cranky Coquí or their respective owners. You may browse the site, share links, and save or print information for personal use. You may not reproduce our designs on merchandise, sell our content, or imply our endorsement without permission. Nothing here limits uses allowed by copyright or other law.

When you send an inquiry, application, review, or other material, provide information you are entitled to share. You retain ownership of your submissions and allow us to use them as needed to respond or provide the requested service. This does not give us blanket permission to use private messages or photographs in advertising. Personal information is handled as described in our Privacy Policy.

 

7 Third party services

The website links to or includes services from other providers, including reservation, food-ordering, delivery, payment, gift-card, and social-media platforms. Their terms and privacy policies govern their own services. We do not control their entire operation, but remain responsible for our own conduct and obligations to you.

 

8 Website availability and limitations

We aim to keep the website accurate and available, but interruptions, technical problems, or errors can occur. To the extent permitted by law, website information and functionality are provided as available, without a promise of uninterrupted or error-free access. This provision concerns website operation; it does not disclaim product descriptions, express promises, mandatory warranties, or statutory remedies.

To the extent permitted by law, Cranky Coquí is not responsible for indirect or consequential losses arising solely from a technical interruption of the website. Nothing in these terms excludes liability for fraud, intentional misconduct, gross negligence, personal injury, or any liability that cannot lawfully be excluded, or limits your right to a required refund or remedy for a purchase.

 

9 Changes to these terms

We may update these terms and will revise the date above. Updates apply prospectively and will not retroactively change an existing order or take away rights that have already arisen. We will provide additional notice or obtain agreement where required by law. Please review the current terms before placing a new order.

 

10 Governing law and enforceability

Connecticut law governs these terms, except where applicable law requires otherwise. You retain any mandatory protections provided by the law that applies to you. If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
